How Social Gems works when you join a brand program and accept Paid Usage Rights.

Agreement to these terms
By creating a creator account, joining a brand program, accepting Paid Usage Rights, or using Social Gems, you agree to these Terms of Service.
If you are using Social Gems on behalf of someone else or a business, you confirm that you have authority to accept these terms for them.
Creator eligibility
You must be able to enter a binding agreement. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these terms.
Social Gems is not intended for children under 13. Do not use the service if you are under 13.
Paid Usage Rights
When you accept Paid Usage Rights for a brand, you grant Social Gems and that brand a paid, non-exclusive right to use your tagged content in paid advertising, marketing, reporting, and related campaign operations.
This license applies to content connected to that brand through Social Gems, including tagged posts, reels, stories, and imported creator content associated with the brand.
You keep ownership of your content. Paid Usage Rights do not transfer copyright ownership to Social Gems or the brand.
Partnership Ads permission
Paid Usage Rights and Meta Partnership Ads permission are separate. Paid Usage Rights allow paid use through Social Gems. Meta Partnership Ads permission allows eligible ads to run as Partnership Ads through Meta.
If Meta Partnership Ads permission is not approved yet, a brand may still be able to run content as a regular brand-handle ad when permitted by the program and applicable settings.
Royalties and payouts
Brand programs may offer royalties, commissions, or other payment terms. The rate shown in the creator dashboard or invitation is the program rate for that brand unless a separate written agreement says otherwise.
Payout timing may depend on ad spend reporting, payment processor timing, fraud checks, minimum thresholds, and accurate creator payout details.
Your responsibilities
You are responsible for making sure content you submit or tag is yours to license and does not violate someone else's rights.
Do not submit content that is unlawful, misleading, harmful, infringing, or that includes third-party rights you cannot license.
Ending participation
You may stop participating in a brand program by contacting Social Gems or the brand. Some ads, reports, or payments may continue to be processed for campaigns launched before the request is completed.
Social Gems may suspend or remove access if we believe there is fraud, misuse, legal risk, or violation of these terms.
Disclaimers and limits
Social Gems is provided as-is and may change over time. We do not guarantee specific earnings, ad performance, approvals from Meta, or continued availability of any brand program.
To the maximum extent allowed by law, Social Gems is not liable for indirect, incidental, special, consequential, or lost-profit damages.
